Terms of Service

1. About Us

Trinity Software Technologies ("Trinity", "we", "us", or "our") is a software development company registered under Indian MSME guidelines, based in Kalayarkoil, Sivaganga District, Tamil Nadu, India. We develop and operate software products for businesses, schools, clinics, churches, hostels, and other organisations.

2. Our Services

Trinity provides the following types of services:

• Software products — ready-made SaaS and desktop software (e.g. JSK Restro POS, RaphaCare, ElRohiCare, JSK School Bus, JSK Banker, and others)
• Custom software development — bespoke web, mobile, and desktop applications built to your specifications
• Website development — business websites, e-commerce, and web portals
• Technical support — setup, training, and ongoing support for our products

3. Accounts & Access

To use our software products, you will be provided with login credentials (username and password). You are responsible for:

• Keeping your login credentials confidential
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorised access

We reserve the right to suspend or terminate accounts that violate these terms or engage in misuse of the software.

4. Payments & Pricing

• Pricing for our products and services is agreed upon before work begins or at the time of subscription
• Payments are due as per the invoice or agreement issued by Trinity
• For SaaS products, subscription fees are billed monthly or annually as agreed
• Online payments are processed securely through Razorpay. Trinity does not store your card or banking details
• All prices are in Indian Rupees (INR) and are inclusive or exclusive of GST as stated in the invoice

5. Refund Policy

• For SaaS products — if you are not satisfied within the first 7 days of a new subscription, contact us for a full refund
• For custom software development — payments made for completed milestones are non-refundable. Advance payments for work not yet started may be refunded at our discretion
• Annual subscriptions — a prorated refund may be issued for unused months if cancelled after the 7-day period, at our discretion

To request a refund, contact us via WhatsApp or email with your invoice number and reason.

6. Your Data

Data you enter into our software products (customer records, transactions, billing data, etc.) belongs to you. We do not use your business data for any purpose other than running the software for you. You may request an export of your data at any time. Please refer to our Privacy Policy for full details.

7. Acceptable Use

You agree not to use our products or services to:

• Violate any applicable Indian law or regulation
• Store or transmit illegal, harmful, or fraudulent content
• Attempt to gain unauthorised access to our systems or other users' accounts
• Reverse engineer, copy, or resell our software without written permission
• Use the software for purposes other than your own legitimate business operations

8. Intellectual Property

All software, code, designs, and content created by Trinity Software Technologies remain the intellectual property of Trinity, unless explicitly agreed otherwise in writing. This includes our products, website, and any custom software developed for clients where ownership transfer has not been specified in the project agreement.

For custom development projects, intellectual property ownership terms will be specified in the project agreement or contract signed before work begins.

9. Service Availability

We aim to keep our SaaS products available 24/7 but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party infrastructure, internet outages, or circumstances beyond our control.

10. Limitation of Liability

To the fullest extent permitted by Indian law, Trinity Software Technologies shall not be liable for:

• Loss of business, revenue, or profits arising from use or inability to use our software
• Data loss due to hardware failure, force majeure, or user error
• Indirect, incidental, or consequential damages of any kind

Our total liability to you shall not exceed the amount paid by you to Trinity in the 3 months preceding the claim.

11. Support & Training

Support is provided via WhatsApp, phone, and email during office hours (Monday–Saturday, 9 AM–6 PM IST). Setup and basic training are included with every product plan. Additional on-site training or extended support may be available at an additional charge.

12. Termination

Either party may terminate a subscription or service agreement with reasonable notice. On termination:

• Your account access will be deactivated
• You may request an export of your data within 30 days of termination
• After 30 days, your data may be deleted from our servers

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify active clients of significant changes via WhatsApp or email. Continued use of our services after changes constitutes acceptance of the updated terms.

14. Governing Law & Disputes

These Terms of Service are governed by the laws of India. Any disputes arising from these terms or our services will be subject to the jurisdiction of courts in Sivaganga District, Tamil Nadu, India. We encourage resolving disputes amicably — please contact us first before pursuing legal action.
